Please read these terms and conditions (“Conditions”) before using this Edwardian House Flowers website.

These Conditions apply to the use of this website. By using this website and/or placing an order for any of the items displayed on the website you confirm that you accept these Conditions and that you agree to comply with them. If you do not agree to these Conditions you should not use this website. 

Edwardian House Flowers is the trading name of Simone Mackie, 68 Dartmouth Road, London NW2 4HA. When used on this website, “we”, “our” and “us” refer Edwardian House Flowers. We can be contacted on 07831 586872 or at info@ehflowers.co.uk.

We may update and change this website (or any part of it) and/or change the Conditions with or without giving notice to you. We may also suspend or withdraw this website.

Orders

You can only make an order for an item displayed for sale on this website (“Product”) by contacting us by phone on 07831 586872 or by email atinfo@ehflowers.co.uk. We will take your name, email address, address for delivery and phone number so that we can process your order. You confirm that the personal information which you provide to us when making an order is accurate.

Orders will be confirmed by email to the address you provide over the phone.

You must pay for your order either with a credit card or debit card or by bank transfer over the phone when you make the order. Receipt of payment will constitute acceptance of your order. Ownership of our Products will only pass to you when we receive full payment of all amounts due.

All orders are delivered free of charge to any address on Mapesbury estate. You must ensure that you or the recipient are at the delivery address so as to take delivery of the order. If you ask us to do so when you place your order, the order can be left with neighbours or in a safe place.

Orders must be placed at least 48 hours in advance due to the perishable nature of the arrangements.

If you want to cancel or amend an order you must contact us by phone or email at least 24 hours before the scheduled delivery date to do so. 

Prices for the Products are subject to change without notice.

We will provide you with a refund or, at our discretion, replacement flowers if the flowers we deliver are not of a reasonable quality.

 

Flowers
Please be aware that some contents of the flower arrangements may be poisonous. We cannot be responsible for any allergic reaction to any of the flowers or other Products sold to you.

You must not resell any of the flowers or other Products you buy from us.

 

Intellectual Property Rights

This website is protected by copyright. We are the owner or licensee of all intellectual property rights in this website and the material published on it. All such rights are reserved. You must not use, print or copy any part of this website, other than to view its contents, choose Products and order from us. You must not use this website for any other purpose. In particular, you must not use any part of the website for commercial purposes without obtaining a licence from us or our licensors to do so.

Limitation of liability

We reserve the right at our absolute discretion to refuse to sell Products to anyone for any reason or at any time. Due to the limited nature of the Products, we reserve the right to limit quantities to individual customers.
While we will make reasonable efforts to check the accuracy of any information we place on the website and keep it up to date, we make no warranties, whether express or implied in relation to its accuracy or completeness or that it is up to date. 

We do not guarantee that the website will be uninterrupted or error-free or that the website is free from viruses or bugs. 

Nothing in the Conditions shall affect your statutory rights as a consumer or exclude or limit our liability for fraud or fraudulent misrepresentation or for death or personal injury resulting from our negligence or where it would otherwise be unlawful for us to do so.

Subject to the previous paragraph:

1. any liability we have in contract, tort or otherwise in connection with any order for a Product shall in no circumstances exceed the price of that order;

2. to the fullest extent permissible under applicable law, we exclude all warranties, representations or other terms of any kind, whether express or implied, in relation to the website or the Products; and

3. we will not be liable to you for any loss or damage, whether in contract, tort or otherwise, arising out of or in connection with the use of the website or the Conditions, including any loss of profit, loss of goodwill or any indirect or consequential loss

 

Invalidity
If any part of the Conditions is found to be invalid or unenforceable, that part shall be deemed deleted and the other parts of the Conditions shall continue to apply.

 

Waiver

A delay or failure to exercise any right or remedy shall not waive that or any other right or remedy. 

 

Entire agreement
These Conditions constitute the entire agreement between you and us. Save in respect of fraudulent misrepresentation, you confirm that, in agreeing to accept the Conditions and placing an order, you have not relied on any statement or representation that is not set out in these Conditions and you agree that you shall have no claim based on any such representation.

Law
The Conditions, and any dispute arising out of or in connection with the Conditions or any order for a Product, are governed by and construed in accordance with English law and you and we both agree to submit to the exclusive jurisdiction of the courts of England.
